Administering a will and distributing an estate can often be challenging, especially when disputes arise over money, property, or the intentions of the deceased. In some cases, financial questions can become so contentious that legal and accounting expertise alone is not enough.
That’s where a forensic accountant will come in to investigate financial discrepancies, uncover hidden assets, and provide expert evidence in court. They combine accounting, auditing, and investigative skills to analyze financial records and find evidence of fraud, mismanagement, or other irregularities.
Margiotti of Pennsylvania Probate and Estate Firm, LLC said their work often supports legal proceedings, making them valuable in disputes involving wills, estates, and trusts.
“They will look for patterns, inconsistencies, and evidence that may reveal financial wrongdoing or errors,” he said. “They are frequently called upon to prepare reports, trace funds, and give expert testimony in court.”
One of the most common reasons to engage a forensic accountant is suspicion of fraud, theft, or misappropriation of estate assets. Executors, trustees, or beneficiaries may notice unexplained withdrawals, missing funds, or discrepancies between what was reported and what exists.
Forensic accountants can trace financial transactions, identify where funds were diverted, and determine whether actions were deliberate or due to error.
In cases where someone has abused a power of attorney before the testator’s death, or where an executor has misused estate funds, forensic evidence can be critical to recovering assets and holding parties accountable.
Margiotti said that estates often include hard-to-value assets such as businesses, real estate, or investment portfolios. Disagreements can arise among beneficiaries about how much an asset is worth, or whether it has been undervalued or overvalued in the probate process.
He added: “Forensic accountants provide independent valuations and assess whether any manipulation or concealment of financial information has taken place.” Analysis ensures a fair distribution of assets based on accurate figures, helping prevent further disputes or litigation.
Their forensic skills are also brought in to provide objective evidence when allegations of undue influence or financial exploitation are levelled, particularly in cases where an elderly or vulnerable person has changed their will unexpectedly.
The accountants are trained to spot unusual transfers, new joint accounts, or gifts made shortly before death, and can provide evidence to support or refute claims.
Margiotti added that accountants are also being drawn into investigations that seek to follow money trails abroad if beneficiaries suspect that not all of the deceased’s assets have been disclosed. Hidden bank accounts, offshore investments, or undisclosed property can complicate estate administration, and asset tracing by a forensic accountant will seek to locate undisclosed funds or properties.
He added: “In contested wills, forensic accountants often work alongside attorneys and probate specialists. Their reports can be submitted as expert evidence in court and carry significant weight because they are based on detailed financial examination rather than opinion or hearsay.”
