Sacramento Attorney Ken Rosenfeld Gets Client Who Shot Police Officer Mental Health Diversion Instead of Possible Jail

Sacramento, CA, June 17, 2024 — A mental health client who shot a police officer and potentially faced a hefty prison sentence has instead been found eligible for pretrial mental health diversion as a result of the mental health criminal defense efforts of California Mental Health Attorney Ken Rosenfeld of The Rosenfeld Law Firm.

According to a motion filed with the California Superior Court, S. Eberle was accused of firing a shotgun into the air from his residence and striking a police officer in 2022. Eberle was charged with three felony offenses: Assault on a Peace Officer, Resisting Arrest, and Discharging a Firearm in a Grossly Negligent Manner.

Pursuant to recent changes made to a California Senate Bill regarding eligibility for mental health diversion, Rosenfeld successfully argued that Mr. Eberle met the eligibility requirements for mental health diversion according to the following factors: He was diagnosed within the past five years with a mental disorder by a qualified mental health expert, his diagnosis was a significant factor in the commission of the charged offenses, and he meets each of the four suitability factors of mental health diversion. Rosenfeld furthermore argued that Mr. Eberle has no criminal history and poses no unreasonable risk to public safety. Following these arguments, the court granted Mr. Eberle with pretrial mental health diversion for the purposes of treatment and continued mental health services.
